Terms & Conditions – Updated 29.05.2019

Applicable to East of England Online, and EOE’s website (eventswhatson.com), and all publications, digital e-magazines (EOE365 and SOE365), and all digital supplements.

 

Terms of Use

Meanings and definitions used in this Agreement:

Agreement – means this agreement for users of the Sites;

Discussion Forums – means the chat areas, bulletin-boards or forum facilities provided on the Sites;

EOEO – means East of England Online;

EOE – means East of England;

EOE365 – means East of England Online’s digital e-magazine;

SOE365 – means South of England Online’s digital e-magazine;

Service – means the service(s) provided by the Site;

Site(s) – means the web site(s) owned and operated by East Of England Online.

 

Advertising, Sponsorship & Promotions

East Of England Online do not offer refunds on advertising once it has gone live on the site, or published in the online magazine. All payments are due prior advertisements going live, and prior art work copy deadline for the online magazine.

No vat to pay, we are vat exempt.

East Of England Online is a FREE site to the public, and the online magazine is also free.

Refunds and Cancellations: Sponsorship and Advertisements in East Of England Online’s Market Place currently stay on the website for a period of one year from the date of going live.

Refunds: Once an advertisement is booked, produced and live, the advertiser may request that it is removed at any time, but refunds are not permitted.

If you terminate your registration of East of England Online’s Buying and Selling website, then we will not refund to you any monies. Termination will not affect our right to recover from you any money you owe to us.

East Of England Online reserves the right to amend copy or editorial or remove an advertiser from the website or online magazine, at any time. Any advertiser that it is deemed necessary to remove from East Of England Online will be refunded any appropriate remaining monies, less the time already spent on the website and less production and administration costs.

Renewals: Advertisers will be contacted to renew their advertisements via emailed automation through Xero.

1. Introduction to Agreement

1.1. This Site is owned and operated by East Of England Online, trading as eventswhatson.com

1.2. This Agreement governs the use of the Site and Service produced by East Of England Online, including participation in the Discussion Forums.

1.3. The Service is designed to provide a forum, enjoyable for all, for the exchange of opinions, comments and information and, therefore, East Of England Online requires its users to abide by the rules of this Agreement. Your use of the Service will constitute your agreement to comply with these rules.

1.4. If you do not agree with the rules contained in this Agreement, you should not use the Service.

1.5. East Of England Online may modify this Agreement from time to time and notice of revisions to this Agreement will be posted here. Continued use of the Service by you will constitute your acceptance of any changes or revisions to the Agreement, so it’s wise to check this page regularly.

1.6. We may terminate your access to the Service, without notice, in addition to our other remedies if you fail to follow this Agreement and the Service’s rules. Please see our Privacy Policy, which is incorporated into these Terms of Use by reference.

 

2. Use of the Service by You

2.1. East Of England Online owns all material on this Site. You may retrieve and display content from this Site on a computer screen, print individual pages on paper (but not photocopy them) and store such pages in electronic form on disk (but not on any server or other storage device connected to a network) for your own personal, non-commercial use. You may not in any way make commercial or other unauthorised use, by publication, re-transmission, distribution, performance, caching or otherwise, of material obtained through the Service.

2.2. You acknowledge that East Of England Online’s brand is a trademark and that you may not use it without prior written permission from East Of England Online.

2.3. You may not authorise others to use the Service, and you are responsible for all of your own use of the Service. You agree not to use any obscene, indecent or offensive language, or to place on the Service any material that is false, defamatory, abusive, harassing or hateful. Further, you may not place on the Service any material that is encrypted, constitutes junk mail or unauthorised advertising, invades anyone’s privacy, encourages conduct that would constitute a criminal offence or give rise to civil liability, or that otherwise violates any local, state, national or international law or regulation. You agree to use the Service only for lawful purposes and you acknowledge that your failure to do so may subject you to civil and criminal liability.

2.4. Other than connecting to East Of England Online’s servers by HTTP requests using a Web browser, you may not attempt to gain access to East Of England Online’s servers by any means, including, without limitation, by using administrator passwords or by masquerading as an administrator while using the Service or otherwise.

2.5. You are responsible for ensuring that any material you provide to the Service or post in a Discussion Area, including but not limited to text, photographs and sound, does not violate the copyright, trademark, trade secret or any other personal or proprietary rights of any third party.

2.6. You agree not to disrupt, modify or interfere with the Service or its associated software, hardware and servers in any way, and you agree not to impede or interfere with others’ use of the Service. You further agree not to alter or tamper with any information or materials on, or associated with, the Service.

2.7. You acknowledge that East Of England Online has not reviewed and does not endorse the content of all sites linked to from this Service and is not responsible for the content or actions of any other sites linked to from this Service. Linking to any other service or site from this Service is at your sole risk. Use of the Discussion Forums By You.

2.8 These Discussion Forum rules have been put in place to help ensure that the Discussion Forum is a welcoming and useful resource for everyone that participates. These rules outline what is deemed unacceptable behaviour and it is important to read them carefully.

2.9 We cannot and do not review every post before it appears on the site. East Of England Online operates a ‘notice and take-down’ policy which means if East Of England Online notices or is made aware of a post that contravenes these rules. East Of England Online reserves the right to amend or remove the post.

2.10 East Of England Online encourages you to contact us if you feel a post violates these rules. Please click the “Report” icon/link to let us know.

2.11 You are responsible for the content of your posts and East Of England Online does not accept any liability for the content or accuracy of your messages. East Of England Online reserves the right to republish any material you submit.

2.12 Users of the Site may submit material for publication in the Discussion Forums. East Of England Online accepts no liability in respect of any material submitted by users and published by East Of England Online and East Of England Online is not responsible for its content or accuracy.

2.13 If you want to submit material to the Discussion Forums you may do so on the following terms and conditions:

2.16 You warrant that the material you submit is not obscene, offensive, harassing, defamatory or otherwise illegal.

2.17 You agree not to post material that is deliberately intended to upset other users.

2.18 You acknowledge that any breach of these warranties may cause East Of England Online damage or loss and agree to indemnify and hold harmless East Of England Online in full and permanently against any third party liabilities, claims, costs, loss or damage incurred by East Of England Online as a result of publishing any material you submit to us, including consequential loss.

 

3. Information and Availability

This is of particular importance to listed What’s On events

While East Of England Online takes every care to ensure that the information on these Sites is accurate and complete, some of it is supplied to East Of England Online by third parties and East Of England Online is unable to check its accuracy or completeness. You are advised to verify the accuracy of any information before relying on it. Further, due to the inherent nature of the Internet, errors interruptions and delays may occur in the service at any time. Accordingly, East Of England Online’s Sites are provided “as is” without any warranties of any kind and East Of England Online does not accept any liability arising from any inaccuracy or omission in the information or interruption in availability.

And whilst every effort is made to ensure the details on this website are correct, the publishers of East of England Online cannot guarantee the accuracy of the information.

4.2. East Of England Online expressly reserves the right to request that any link in breach of these terms be removed and to take whatever other action it deems appropriate.

4.3. On these Sites you may be offered automatic links to other sites. Whilst East Of England Online hopes you will be interested in those other sites, you acknowledge that their owners may be independent from East Of England Online and East Of England Online does not endorse or accept any responsibility for their content.

4.4. Pages of the site may contain some contextual affiliate marketing links created by Skimlinks, a service that works on behalf of 3rd party online retailers. Purchases made on these 3rd party sites are the sole responsibility of that site. Purchases made through these links may result in a commission being earned by East Of England Online

 

5. Use of Material Posted by You

5.1. Postings to the Discussion Forums are not private. You grant East Of England Online and its designees a perpetual royalty free non-exclusive licence to use, reproduce, modify, translate, transmit, distribute and sub-licence any information or material you supply or communicate to the Service via such postings, in any medium now in existence or hereafter developed, for any purpose, including commercial uses. East Of England Online will not return it if submitted, and accepts no liability whatsoever for safe custody thereof.

5.2. All other information and material you supply or communicate to the Service is governed by the Privacy Policy, which is accessible at any time from the bottom of any page on the Service.

 

6. Copyright Complaints

6.1. East Of England Online respects the intellectual property of others, and we ask our users to do the same. East Of England Online may, in appropriate circumstances and at its discretion, terminate the access of users, subscribers, and account holders who infringe the copyright rights of others.

6.2. If you believe that your work has been copied and is accessible on any East Of England Online Site in a way that constitutes copyright infringement, or that the Site contains links or other references to another online location that contains material or activity that infringes your copyright, please contact East Of England Online immediately.

 

7. Copyright responsibilities for advertisers

7.1. East Of England Online take no responsibility for advertisers use of images on our site/e-magazine.

7.2. Please note all professional photographs require written permission from the photographer before they can be used on East Of England Online. Please ensure that you have permission to use any photograph submitted with your advert, East Of England Online cannot be held responsible for any copyright fees. You must ensure that you have the legal and ethical right to use an image, and ask permission to use all images. If in doubt, don’t use the image!

8. Comments by Users Are Not Endorsed by East Of England Online

8.1. East Of England Online does not necessarily endorse, support, sanction, encourage, verify or agree with the comments, opinions or statements posted by users in Discussion Forums or elsewhere in the Service. Any information or material placed online by users, including advice and opinions, is the view and responsibility of those users and does not necessarily represent the view of East Of England Online.

10. Competitions and Prizes

These rules apply to all prize promotions including free draws, prize competitions and instant win offers.

10.1. From time to time East Of England Online will run competitions, free prize draws and promotions on this website. These may be subject to additional terms that will be made available at the time.

10.2. Promotions are open to UK residents aged 18 and over.

10.3. Prizes are non-transferable, non-negotiable and no cash alternatives will be offered.

10.4. East Of England Online and the promoter reserve the right to substitute the prize for another prize of equal value.

10.5. NO PURCHASE NECESSARY to enter the competitions unless otherwise stated on the promotional activity with a specific competition.

10.6. By entering the prize draw, the entrant agrees to be bound by the rules and by any other requirements set out in the promotional material accompanying the promotion.

10.7. By entering the promotion, the entrant agrees to the terms of the privacy policy. In addition East Of England Online may pass your personal information to the promoters and their data processors. However, we always demand that those parties adhere to the same security procedures that we follow ourselves.

10.8. It is assumed that by entering competitions which, if won, could result in time off work, your employer is in agreement to time off. When dates are specified they cannot be altered.

11.2. If you apply to become a Registered User you will be asked to click to “Accept” these Terms. If you refuse to do so, you will not be able become a Registered User. Where you have refused to click to “Accept” but continue to use the site as a visitor your continued use of the website will indicate acceptance of these Terms.

11.3. East of England Online’s website is a Venue.

11.4. We are not responsible for contracts for the supply of goods, services or information formed through East of England Online’s website, (or as a result of visits made to our site) between you and other site users. We are simply a venue.

11.5. Any contract is between the buyer and the seller and is subject to the terms and conditions which are implied by law or which the buyer and seller agree between themselves or both. East of England Online is not a party to the contract between the seller and buyer nor is East of England Online liable under it.

11.6. East of England Online do not provide any warranties or assurances in relation to the Items you purchase (or attempt to purchase) from third party sellers through East of England Online’s website, or from companies to whose website we have provided a link on/to, and any such warranties and assurances are DISCLAIMED by us absolutely. This DISCLAIMER does not affect your statutory rights against the third party seller. If you would like information about your legal rights you should contact your local trading standards or citizens advice bureaux.

 

12. Access to East of England Online’s website.

12.1. From time to time, we may restrict access to some parts of East of England Online’s website or the whole of East of England Online’s website to Registered Users or just Upgraded Users.

12.2. You are responsible for making all arrangements necessary for you to have access to East of England Online’s website. You are also responsible for ensuring that all persons who access our site through your internet connection are aware of these Terms and that they comply with them.

13. Membership Accounts and User Names

13.1. You may create only one membership account per person. You may not assign, transfer or otherwise deal with your membership.

13.2 You user name must not:

(a) contain any swear words or expletives or any words which could be construed as such in any language; or

(b) damage our goodwill or reputation or that of any entity with which we are associated including in each case officers, employees, personnel, members, customers and stakeholders; or

(c) breach our or any third party rights; or

(d) imply any connection with us. For example, your user name must not include the word “East of England Online” nor must it use any of our trade marks or any confusingly or colourably similar words or expressions.

13.3. We may, without prejudice to our other rights and remedies, require you to change your user name or change it ourselves.

13.4. If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any third party. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our opinion you have failed to comply with any of the provisions of the Terms.

13.5. You are responsible for any use of East of England Online’s website under your password and login details. We have no responsibility for such use. If you become aware of any unauthorised use of your password or login details please contact us immediately at info@eastofenglandonline.com.

 

14. Registered Users

14.1. By becoming a Registered User, you warrant that:

(a) you are legally capable of entering into binding contracts; and

(b) you are at least 18 years old or if you are a Minor you have the prior written consent of your parent or guardian to become Registered User.

14.2. Your application to become a Registered User constitutes an offer by you to us to enter into a binding contract with us to become a Registered User. We do not have to accept your application. We will act in accordance with the law when deciding whether or not to accept your application.

14.3. A contract, in relation to your use of East of England Online’s website as a Registered User, will come into existence and these Terms shall become binding on you in respect of such use and us when you begin to use East of England Online’s website as a Registered User.

14.4. English is the only language in which our contract may be concluded.

 

15. Upgraded Users: Price and Payment

15.1. Some Services require payment in full before their use. In such cases the amount payable will be clearly indicated.

15.2. We may change our prices from time to time. In which case you will be notified of this in advance and have the opportunity to decline payment. If you decline payment you will not receive the Services to which such payment relates.

15.3. We will not start to provide the paid-for Services (and shall be under no obligation to do so) until we have been paid in advance in accordance with these Terms.

15.4. Without limiting any other remedies or rights that we may have, if you do not pay us on time, we may cancel or suspend our performance of the paid-for Services until you have paid the outstanding amounts.

15.5. You are given the opportunity to check your Application and cancel it or amend it prior to its final submission to us. You have agreed that we will begin to provide the Services immediately on our issuing a Confirmation. Please note that once we have issued a Confirmation, provided you with a copy of these Terms in a durable medium and we have begun to provide the Services (i.e. activated your account) you may not cancel or amend our contract and you will lose any cancellation rights which you may have had under the Consumer Protection (Distance Selling) Regulation 2000. This does not affect your other statutory rights and you may still cancel our contract where you are legally entitled to do so, for example, in accordance with these Terms or because of our breach.

 

16. Posting to East of England Online’s website

16.1. You are solely responsible for your Content when using East of England Online’s website. We are not responsible, or liable whatsoever, for the content or accuracy of any Content Posted by you or any other user of East of England Online.

16.2. You undertake that any Content Posted by you will comply with those standards and you indemnify us for any breach of that undertaking.

16.3. Any Content you Post to East of England Online’s website will be considered non-confidential and non-proprietary. By Posting Content you grant to us an irrevocable, worldwide, royalty free and sub-licensable licence and right to use, copy, distribute and disclose to third parties any such Post and Content for any purpose.

 

17. No Duty to Monitor or Moderate

17.1. We are under no duty to you to monitor or record the activity of any East of England Online user.

17.2. Content generated by Registered Users is not moderated.

17.3. We have the right (but not the obligation) to monitor any Posting or Content and we have the right to refuse, reclassify or remove any Post or edit any Content, for example (but without limitation) if:

(a) in our opinion, such material does not comply with our Terms; or

(b) we are notified that it may be offensive, illegal or defamatory.

17.4. Please note that Content includes messages sent via our on-line messaging service. This means that messages are not confidential and are not proprietary. We may view, refuse, reclassify or remove messages even if you have not opened the message.

17.5 Storage of Content (Including Messages)

17.6. We assume no responsibility for the deletion or failure to store, deliver or timely delivery of messages or other Content.

17.7. We may, from time to time and without notice, set limits on the number of messages a Registered User may send, store or receive through the Service and we retain the right to delete any messages about such limits without any liability whatsoever. Any notice provided by us to you in connection with such limits shall not create any obligation to provide future notification.

 

18. Other Users of East of England Online’s website: Risks

18.1. You understand that by using East of England Online’s website you may receive or be exposed to third party Content which you may find indecent, offensive or objectionable but you use Preloved at your own risk and we are not responsible for such third party content.

18.2. You understand that we cannot verify the identity of users. This means that some users may not be who they say they are.

 

19. Minors

19.1. Minors are not permitted to become Registered Users of East of England Online’s website without the consent of a parent or guardian.

19.2. Parents and guardians are responsible for supervising Minors when they use East of England Online’s website and undertake to us to do so. This is not our responsibility.

19.3. We advise parents and guardians who permit minors to use East of England Online’s website that it is important that they communicate with them about their safety online. This is not our responsibility. Minors who are using Preloved should be made aware by you of the potential risks to them and of their obligation to comply with the Terms when using East of England Online’s website.

20. Viruses, Hacking and Other Offences

20.1. You must not misuse East of England Online by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to East of England Online, the server on which East of England Online is stored or any server, computer or database connected to East of England Online. You must not attack East of England Online via a denial-of-service attack or a distributed denial-of service attack.

20.2. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use East of England Online will cease immediately.

21. We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of East of England Online or to your downloading of any material posted on it, or on any website linked to it.

 

22. Limitation Of Liability

22.1. The material displayed on East of England Online’s website (including without limitation Content and Posts) is provided without any guarantees, conditions or warranties as to its accuracy.

22.2. Subject to the extent permitted by law, we, other members of our group of companies and third parties connected to us hereby expressly exclude:

(a) all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity;

(b) any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with East of England Online’s Buying and Selling website or in connection with the use, inability to use, or results of the use of East of England Online’s website, and any websites linked to it and any materials posted on it, including, without limitation any liability for:

(i) loss of income or revenue;

(ii) loss of business;

(iii) loss of profits or contracts;

(iv) loss of anticipated savings;

(v) loss of data;

(vi) loss of goodwill;

(vii) wasted management or office time; and

for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable, provided that this condition shall not prevent claims for loss of or damage to your tangible property or any other claims for direct financial loss that are not excluded by any of the categories set out above.

22.3. Nothing in these Terms limits or excludes our liability for death or personal injury arising from our negligence, or our liability for our fraudulent misrepresentation or our misrepresentation as to a fundamental matter nor for any other liability which cannot be excluded or limited under applicable law.

22.4. Without prejudice to the general limits on our liability:

(a) we are under no obligation to you to monitor or record the Postings, Content or other activities of users of East of England Online’s website;

(b) we do not assume any responsibility for the quality, safety or legality of Items;

(c) we do not assume any responsibility for the truth or accuracy of any Postings or Content;

(d) we make no promises, warranties or guarantees about your ability to buy or sell Items using East of England Online’s website;

(e) we are not responsible for third parties. For example, it is not our responsibility if a seller does not deliver Items, if the Items are not as described or if a buyer does not pay for Items.

 

23. No Reliance

23.1. Commentary and other materials posted on East of England Online’s website are not intended to amount to advice on which reliance should be placed. We therefore disclaim all liability and responsibility arising from any reliance placed on such materials by any visitor to East of England Online’s website, or by anyone who may be informed of any of its contents.

 

24. Events Outside Our Control

24.1. We will not be liable or responsible for any matter arising out or in connection with events outside our reasonable control, including without limitation:

(a) strikes, lock-outs or other industrial action;

(b) civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war; or

(c) fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster; or

(d) impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport; or

(e) impossibility of the use of public or private telecommunications networks.
each a (“Force Majeure Event”).

24.2. Our obligations shall be suspended for the period that the Force Majeure Event continues, and we will extent the time to perform these obligations for the duration of that period. We will take reasonable steps to bring the Force Majeure Event to a close or to find a solution by which our obligations under these terms can be performed despite the Force Majeure Event.

 

25. Interruption of Service

25.1. Access to East of England Online is permitted on a temporary basis. We reserve the right to interrupt, withdraw or amend the Service without notice. For example, if it is necessary or desirable for us to interrupt the Service (for example for routine maintenance) then we may do so without telling you first.

25.2. You agree that we are not liable to you for any loss whether foreseeable or not arising out of or in connection with unavailability or interruption of the Service except that, if you are a Upgraded User and the Service has been unavailable for a continuous period of 7 days your only remedy is to terminate your contract and we will refund the unused portion of your fees.

 

26. Ending Our Contract

26.1. You may terminate your registration at any time, for any reason, with immediate effect by contacting us via info@eastofenglandonline.com. We reserve the right to check the validity of any request to terminate registration.

26.2. We may terminate your registration at any time, for any reason, with immediate effect by contacting you at your last known postal or e-mail address.

26.3. We may terminate your registration without notice if you breach our Terms.

 

27. Written Communications

27.1. Applicable laws require that some of the information or communications we send to you should be in writing. When using East of England Online, you accept that communication with us will be mainly electronic. We will contact you by e-mail or provide you with information by posting notices on our website. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

 

28. Notices

28.1. All notices given by you to us must be given to East of England Online at info@eastofenglandonline.com. We may give notice to you at either the e-mail or postal address you provide to us when you register or by posting the information on East of England Online’s website. Notice will be deemed received and properly served immediately when posted on East of England Online, 24 hours after an e-mail is sent, or three days after the date of posting of any letter. In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in the case of an e-mail, that such e-mail was sent to the specified e-mail address of the addressee.

 

29. Transfer of Rights and Obligations

29.1. The contract between you and us is binding on you and us and on our respective successors and assignees.

29.2. You may not transfer, assign, charge or otherwise dispose of a Contract, or any of your rights or obligations arising under it, without our prior written consent.

29.3. We may transfer, assign, charge, sub-contract or otherwise dispose of a Contract, or any of our rights or obligations arising under it, at any time during the term of the Contract.

 

30. Severability

30.1. If any court or competent authority decides that any of the provisions of these terms and conditions are invalid, unlawful or unenforceable to any extent, the term will, to that extent only, be severed from the remaining terms, which will continue to be valid to the fullest extent permitted by law.

 

31. Entire Agreement

31.1. These Terms and any document expressly referred to in them constitute the whole agreement between us and supersede all previous discussions, correspondence, negotiations, previous arrangement, understanding or agreement between us relating to the subject matter of any Contract.

31.2. We each acknowledge that, in entering into a Contract, neither of us relies on any representation or warranty (whether made innocently or negligently) that is not set out in these terms and conditions or the documents referred to in them.

31.3. Each of us agrees that our only liability in respect of those representations and warranties that are set out in this agreement (whether made innocently or negligently) will be for breach of contract.

31.4. Nothing in this clause limits or excludes any liability for our fraud.

31.5. Our Right To Vary These Terms And Conditions

31.6. We have the right to revise and amend these terms and conditions from time to time.

31.7. We may revise these terms of use at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we made, as they are binding on you.

 

32. Severance

32.1. If any court or competent authority decides that any of the provisions of these terms and conditions are invalid, unlawful or unenforceable to any extent, the term will, to that extent only, be severed from the remaining terms, which will continue to be valid to the fullest extent permitted by law.

33. Status

33.1. Nothing is intended to or shall be deemed to establish any partnership of joint venture between us or make either of us an agent or employee of the other.

 

34. Third Party Rights

34.1. A person who is not party to these terms and conditions or a Contract shall not have any rights under or in connection with them under the Contracts (Rights of Third Parties) Act 1999.

 

35. Dispute Resolution

35.1. If any dispute arises out off or in connection with East of England Online, we will first attempt to settle it by mediation in accordance with the Centre for Effective Dispute Resolution (CEDR) Model Mediation Procedure. Unless otherwise agreed between us, the mediator will be nominated by CEDR.

 

36 Jurisdiction and Applicable Law

36.1. The English courts will have non-exclusive jurisdiction over any claim arising from, or related to, a visit to East of England Online although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country.

36.2. These terms of use and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.

 

37. Payments

37.1. East of England Online Buy and Sell Does NOT Handle Payment, and takes no responsibility for payments or any financial transactions between buyers and sellers.

Freelancers, Contributors, Volunteers and Ambassadors

East of England Online employs the ‘services’ of freelance writers, photographers, and contributors.

East of England Online’s Arts Award Gold is designed for young people aged 16 to 25, who undertake an exclusive EOE assignment on a volunteer basis.

East of England Online’s Digital Brand Ambassadors undertake regular exclusive EOE assignments on a volunteer basis.

Freelance writers, photographers, contributors, digital brand ambassadors, and arts award young people are NOT employed by East of England Online and have no rights, and are not insured by East of England Online, and no liability will be accepted by East of England Online for any accidents or incidents whilst out on assignments commissioned by East of England Online.
And all material whilst on EOE assignments is the copy right of East of England Online, and all rights are reserved.
